1. Eligibility & Accounts

You must be at least 18 years old and legally able to enter into binding contracts to register and bid. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Information you provide must be accurate and kept up to date.

2. Bidding

Each auction on DEX Auctions is for a single item. When you place a bid you make a binding, irrevocable offer to purchase that item at the bid amount. Bids cannot be retracted once submitted. The minimum bid is the current highest bid plus the item’s stated bid increment (or the starting bid if no bids have been placed).

Auctions are timed and close at the stated end time (South African Standard Time, CAT). To ensure fair bidding, an anti-sniping rule applies: a bid placed in the final minutes may extend the auction end time. The highest valid bid when the auction closes wins the item.

3. Winning & Payment

If you are the highest bidder when an auction closes, you are contractually obliged to complete the purchase. Payment is made by Electronic Funds Transfer (EFT) using the banking details and reference provided to you. Full payment must be received within 48 hours of the auction closing unless otherwise agreed in writing.

Ownership and risk in the item pass to you upon receipt of full and cleared payment. Failure to pay may result in cancellation of the sale, suspension of your account, and forfeiture of your right to bid on future auctions.

4. Condition of Items – Voetstoots / Sold “As Is”

All items sold on DEX Auctions are sold voetstoots, that is, “as is” and “with all faults”.

Every item is purchased in its existing condition at the time of sale, whether or not such condition is apparent on inspection. Descriptions, photographs, categories and condition notes are provided in good faith as a guide only and do not constitute a warranty or guarantee of any kind. DEX Auctions and the seller give no warranties, express or implied, as to the quality, merchantability, fitness for a particular purpose, authenticity, age, origin, completeness or working order of any item.

You are strongly encouraged to inspect an item and satisfy yourself as to its condition before bidding, as by placing a bid you accept the item voetstoots. No claim, refund, return, exchange or reduction in price will be entertained on the basis of the condition of an item, defects (latent or patent), or any discrepancy between the item and its description, save as expressly required by applicable law.

5. Collection & Delivery

Arrangements for collection or delivery of a won item are made after payment has cleared. Any delivery costs are for the buyer’s account unless expressly stated otherwise. Items must be collected or delivery arranged within the period communicated to you.

6. Prohibited Conduct

You may not manipulate bidding, use the Platform fraudulently, place bids you do not intend to honour, or interfere with the operation of the Platform. We reserve the right to cancel bids, remove listings, and suspend or terminate accounts that breach these Terms.

7. Limitation of Liability

To the maximum extent permitted by law, DEX Auctions shall not be liable for any indirect, incidental or consequential loss arising from your use of the Platform or your purchase of any item. Nothing in these Terms limits liability that cannot lawfully be limited.

8. Changes to these Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

9. Shipping

Shipping costs are not included in the bid price. Shipping will be calculated separately after the auction closes, based on the location of the winning bidder and the item. The winning bidder is responsible for all shipping and delivery costs. Collection may be arranged as an alternative — please contact us at [email protected] for more details.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and you submit to the non-exclusive jurisdiction of the South African courts.
